Sued for what? Being too awesome?
Please do create a lawsuit for gem traps, false advertising, deceptive business practices. Record the convo you have with the lawyer and post it here. I'm sure you'll make millions and lawyers are just lining up to sue over this adult game
I have the same feeling.
TL are distributing their games here in various countries and in doing so you breach several laws present in every country, for example you don't protect minors incapable of contracting from spending too much money on virtual goods.
Your domain is set up through 'domains by proxy' to make it impossible for peoples lawyers to send you c&d letters.
The whole setup of your company seems to have just a single goal: Make money from questionable activities.
I'll try to get a broader public to consider your methods, perhaps bad PR will make you change your behaviour.
There is nothing shady about enabling privacy on domains. It is standard practice nowadays.
But I do agree that there should be more openess and transparency especially when we are sending our cash to them. I too have invested many hours and days in this game and between teamlava and storm8 I have spent more than I would for a PS3 game. Complaints about gem traps and nonexistent weekly updates need to be acknowledged. If I don't get at least an acknowledgment from teamlava staff soon I will be done wasting my time and money with them.
My excitement for these games is diminishing rapidly.
FYI
If a lawyer wanted to get in contact with an officer of teamlava they would likely request this information from the secretary of state where the company incorporated.
Teamlava is incorporated in California. Doing a simple search on California's Secretary of State website shows the physical address and corporate filing numbers. It also links to a request form where you can get the names and addresses of the officers of the corporation. CA charges a nominal fee for this but it is public information as with all corporations. Some states let you view it for free from the web. CA makes it a little more difficult.
It'll cost you in lawyers fees. I can't see any judge seeing this as being more than a frivolous action.
A free game that won't give you free stuff in a quicker time frame.
Go ahead, waste your money. I'm sure a lawyer would be happy to take it.
The contractural argument in null. The account belongs to an age of majority.(iTunes) If it doesn't, then it's not lavas issue. It's apples. Good luck taking them on. If a person let's their child use a device and accesses their account, it's the account holders contractural responsibility.
If my kid uses my wallet with my permission, and makes charges on the c.c....guess what? I'm responsible. Same concept.
It amazes me the number of people who hold themselves accountable for nothing.
As for gem traps? What? I've played for quite awhile. Goofed once and did a gem for coin swap becaue I, ME, was tapping too fast. I've been more careful since and guess what...not one single problem. A judge won't hold them responsible for you tapping too fast when you can alter your action and slow down.
As for FREE WEEKLY UPDATE ad. Hmmm. Operative word FREE. This will only be an issue for me had I fronted money when I downloaded. As it was free, cost me nothing, it's a non issue.
The law will only take interest if consumers lose $. Yes $. As it's free....
A judge will tell you to delete the game if youre unhappy with it and stop bringing frivolous actions before the court, that is already overloaded with REAL issues. That is your sole remedy. Delete it. So yes, by all means, try and hire a lawyer. The only one that would take this is a shyster, so he or she can part you from your money....all over a FREE game. Don't be surprised when you have to pay any of lavas legal costs for defending a frivolous action.
There is all kinds of case law on the Internet. (lexis in us). Try researching your issue before making such inane threats and statements. There is no case. Sorry. You may not like it but there it is.
Research case law decisions on false advertising. Successful cases must prove a sig loss, or potential for sig loss, or create a life altering belief....with a financial loss tied to it. Or have a detrimental life effect. Like take free goo to cure your cancer instead of listening to doctors. That qualifies as criminal...sometimes. But even that isn't an open and shut case.
Another Eg. $5 pills will cure your cancer. That's fraud, that's false advertising. To most people. Not only a civil case, but criminal as well. But I can tell you, there are many variables that can preclude culpability....so even that is not a simple clear cut case.
So ok...you want to make your life battle about a free game, go a head, I wish you well. But don't say you weren't warned. You won't win, and it will cost you big.
Free game...not getting free promised updates? No loss. No case.
Quite simply....you have no case. Any lawyer worth their grain will tell you this.
Stupid
Btw...
I'm not calling anyone stupid...
To me the issue of legal action is stupid. Not the people who are frustrated. The post wasn't wholly meant for the poster I quoted either.
I understand your frustration. I do. But this topic is going down the wrong path....it's the taking of that path that I think is stupid. But we all do stupid things at times and some need to learn the hard way. Too bad it will cost them a great deal pursing this if they chose, only to have one option. Delete.
Fortunately your opinion means as much or as little as anyone else's.
And you misquoted the printed description in the app. It DOES NOT state "free weekly update" it does however state:
"New content will be released every week so the game continually gets even better."
If you want to cite "case law" you have to actually CITE specific cases and the courts' decisions. Using the term case law means nothing. If you want to use legal speak to support your argument, you need a working knowledge of the law, not simply your understanding of it. I wouldn't ask an attorney for medical advice any sooner than I'd seek legal advice from a marketing exec.
Yes people are muddying the water with issues that are not the responsibility of Teamlava (aka kids purchasing gems... Why do they have YOUR password which is linked to your credit card?) but to say the discussion of the potential for legal action is stupid is offensive, childish and your opinion.
If anyone is so inclined, a free option to consumers is available. There are numerous consumer rights advocate groups who may be able to assist anyone who has concerns regarding Teamlava and their conduct.
smut in an attempt to halt discussion
Pathetic... Seriously
